Article 1 - Designation of the seller

This website www.loestudio.fr is published by LOE Studio , SAS, with a capital of 2,000 (two thousand) euros , registered with the Lille Trade and Companies Register under number 888 267 085, whose registered office is at 10 impasse Montevideo, 13006 Marseille. Its legal representative is Ms. Juliette GILLIER.

This website aims, among other things, to offer:

- the purchase of jewelry (upcycled or not).

Article 2 - Scope and Modification of the General Terms and Conditions of Sale (GTC)

The customer acknowledges, at the time of placing the order, that they are aware of the specific terms and conditions of sale stated on this page and declares that they accept them without reservation.

These general terms and conditions of sale govern the contractual relationship between LOE Studio and its customers within the framework of a distance selling system, both parties accepting them without reservation. These terms and conditions shall prevail over all other terms and conditions. LOE Studio reserves the right to adapt or modify these general terms and conditions of sale at any time. In the event of modification, the general terms and conditions of sale in effect on the date of the order will apply to each order. The parties agree that this contract is governed by French law.

Article 3 - Selling Price

Prices are quoted in Euros, inclusive of all taxes, excluding delivery charges except for special offers. They include VAT applicable on the date of the order. Any change in the applicable VAT rate may be reflected in the product prices, which are then subject to change at any time. All orders, regardless of origin, are payable in Euros. LOE Studio may change its prices at any time, but products will be invoiced based on the rates in effect at the time the order is registered, subject to availability. The total amount due by the consumer is indicated on the order confirmation page. Products remain the property of LOE Studio and its suppliers and/or authorized resellers until full payment is received.

LOE Studio reserves the right to offer promotions on fixed dates and while stocks last.

Promotional codes are valid for a limited time. After the specified period, the discount will no longer apply. Promotional codes cannot be combined.

Article 4 - Products

Information regarding the colour and size of the products is provided for guidance purposes only and cannot be considered contractual.

All photos on the website www.loestudio.fr are for illustrative purposes only and are not contractually binding. Furthermore, the information provided on this website is intended to help the customer make the most informed and accurate choice possible. LOE Studio cannot be held liable for any errors that may appear on the website.

Regarding the jewelry, the raw material used may be old, it may have signs of wear, scratches or defects due to its age.

The choice of products rests solely with the customer, who is solely responsible for it. Therefore, LOE Studio cannot be held liable in any way for the suitability of the consumer's choices to their needs. Furthermore, the customer is solely responsible for the consumption, ingestion, and/or absorption of the products by themselves or any third party, and for any resulting health consequences.

Unless otherwise provided by law, no incompatibility of the products offered by LOE Studio with the consumer's state of health (such as allergies) will give rise to compensation, reimbursement, or liability on the part of LOE Studio.

Article 5 - Offer

The online jewelry sales offered on this website are reserved for consumers residing in France and Europe. Our products are presented on their respective product pages and descriptions, using images and text. These images are provided for illustrative purposes only and may not accurately represent the item, the characteristics of which are defined in its description.

Our product and price offers are subject to availability. When you place your order, we will check the availability of the product(s) ordered.

In the event of a temporary shortage of one or more of the items ordered, LOE Studio will inform you of a risk of delivery delay and will offer you, if necessary, a new delivery date.

In the event of a definitive cancellation, the buyer is immediately informed and offered a product of equivalent quality and price or, failing that, a voucher for the amount of the order, valid for any future purchase. If the buyer does not agree, the seller will refund the sums paid within one month. Beyond the refund of the price of the unavailable product, the seller is not liable for any cancellation compensation, unless the non-performance of the contract is directly attributable to them.

Article 6 - Order

Orders are placed online at: www.loestudio.fr

Before confirming payment, the consumer has the opportunity to review their order details and total price. They can also return to previous pages to correct any errors or modify their order.

Order confirmation implies acceptance of these Terms and Conditions and forms the contract.

Following the order, LOE Studio sends an email acknowledging receipt of the order and payment.

LOE Studio reserves the right to make modifications to the ordered product related to technical advancements, in accordance with the provisions of Article R. 132-2-1 of the French Consumer Code. Prices may be adjusted at any time, depending on factors such as the materials used and available stock. The consumer is guaranteed to receive the price in effect on the date of the order.

LOE Studio reserves the right to refuse any order for legitimate reasons. These reasons may include, but are not limited to, an order placed after the deadline, an offer that is no longer available, or the existence of a dispute concerning payment for a previous order.

The information provided by the customer when placing the order is binding: in the event of an error in the recipient's contact details, LOE Studio cannot be held responsible for any resulting inability to deliver the product. Scheduling a new shipment will cost €5 at the customer's expense.

LOE Studio is not responsible for the content of the personal message included with the ordered product. LOE Studio may not forward a message if its content is deemed objectionable. In this case, LOE Studio will inform the consumer directly and invite them to modify or delete the message.

In accordance with Article L121-10 of the French Consumer Code, the consumer has a period of fourteen clear days from the delivery of the package to withdraw from their order. To exercise this right, the customer must contact LOE studio ( sav@loestudio.fr ), return their package before the expiry of this period, at their own expense, in its original condition and packaging, to the following address: SAV LOE STUDIO, c/o MESURE CLUB, 10 impasse Montevideo, Marseille 13006. LOE will reimburse the customer within 45 (forty-five) days of the return date and after receipt of the returned item.

Any incomplete, damaged, or defective product, or any product whose original packaging has been damaged, will not be refunded or exchanged. LOE requests that the customer use a carrier that offers tracking and insurance for returned merchandise. In the event that the package is lost or damaged in transit, LOE Studio will not be able to reimburse the buyer, who must file a claim directly with the carrier. When exercising the right of withdrawal, only the price of the purchased product(s) will be refunded. Shipping and return costs are the responsibility of the buyer.

Any order modification requested by the customer after order confirmation must be made 48 (forty-eight hours) before the scheduled delivery date. After this deadline, any order modification will be subject to acceptance by LOE Studio and must be sent to the following address: sav@loestudio.com

In the event of a modification to the initial order, deletion or addition of item(s), the shipping costs will be recalculated.

If one or more items are removed, the initial shipping cost remains the same. If the customer adds one or more items, the shipping cost is recalculated and adjusted based on the added weight of the order.

Article 7 - Contract

The sales contract is formed when the consumer sends confirmation of their order.

The data recorded by LOE Studio serves as proof of all transactions between LOE Studio and its clients. Contracts are stored electronically. The data recorded by the secure payment system constitutes proof of financial transactions.

The order can be cancelled by the consumer by registered letter with acknowledgment of receipt, by email or by written notice on another durable medium in the following cases:

- delivery of a product that does not conform to the characteristics stated on the product sheet;

- of an unjustified price increase as defined by these Terms and Conditions

The order can be resolved by LOE Studio in the following cases:

- the buyer's refusal to take delivery;

- non-payment of the price (or the balance of the price) at the time of delivery.

Article 8 - Delivery

For items such as jewelry, the average delivery time from the date of payment is 2 (two) to 12 (twelve) business days. This average time is only an estimate and depends, among other things, on the nature of the items in the order. Delivery times are not guaranteed. The customer will receive an email notification when their package has been shipped. Items (excluding floral arrangements) can be shipped throughout France; shipping costs are calculated at checkout based on the weight and destination of the package.

The products are delivered to the delivery address that the customer specifies when validating their order.

In the event of an error in the delivery information (incomplete address, incorrect or missing recipient information) resulting in a failed delivery, LOE Studio cannot be held responsible for any delivery issues. Any subsequent delivery or re-delivery may be billed to the customer.

Any claim regarding the conformity and quantity of the delivered items must be notified to LOE Studio within three days of receiving the package (in accordance with Article L 133-3 of the French Commercial Code). After this period, the delivery is considered accepted.

Any validation by the customer or authorized recipient of the transport document (delivery slip given by the courier) without reservation constitutes acceptance of the delivery.

No claims will be accepted for early or late delivery.

If the product does not conform to the order, the consumer must submit a claim to LOE Studio to obtain a replacement or, if necessary, a refund. If the products are unavailable for delivery, LOE Studio may offer an equivalent product (in terms of quality and price).

Total failure to deliver results in the automatic termination of the sales contract.

The risks of loss or damage to the goods are transferred to the customer at the moment when he or a third party designated by him takes physical possession of the goods.

The product, which is made available to the consumer, travels at the consumer's own risk from the moment the goods are handed over to the consumer or the stated recipient.

Article 9 - Intellectual Property

All texts, illustrations, and photographs displayed on the website www.loestudio.fr are protected by intellectual property rights. Any reproduction or use, even partial, without prior authorization is strictly prohibited.

Article 10 - Liability

All products offered comply with current French legislation.

The photographs and texts used to illustrate the products are not contractual. LOE Studio cannot be held liable for any errors in these photographs or texts.

Article 11 - Right of withdrawal

The customer is responsible for the return shipping costs for cancellations.

The item(s) must be returned in their original, undamaged packaging. All accessories must be included and in their original condition. LOE Studio reserves the right to refuse any return that does not comply with the above specifications.

From the date of delivery, you have 14 days to return the ordered product for exchange .

Return shipping costs are the responsibility of the customer. Exchanges are free. We do not offer refunds. Unique pieces and custom creations are neither exchangeable nor refundable. Sale jewelry is neither exchangeable nor refundable.

Items must be returned undamaged (unworn and unused) in their original packaging. They must be accompanied by all accessories. We reserve the right to refuse any non-compliant or damaged returns.

We recommend using a tracking service for your package (to have proof of your return and ensure we have received it). We cannot be held responsible for a shipment that does not reach us.

The items must be returned, along with a piece of paper stating your name, surname and order number, to the address below:

Once we receive your return, we will issue you a credit note for the amount of your order , valid for one use only on our entire website for 1 year.
